These Terms of Service ("Terms") are a binding agreement between you and Maxify governing your use of the Maxify app. By downloading or using Maxify, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app. Effective July 2, 2026.

You must be at least 13 years old to use Maxify. If you are between 13 and 18, you may use the app only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.

Maxify provides automated, subjective cosmetic feedback and self-improvement routines for informational and entertainment purposes only. The scores and suggestions are AI-generated estimates. Maxify is NOT a medical, dermatological, mental-health, nutritional, fitness, or other professional service, and nothing in the app is professional advice. Do not rely on Maxify to diagnose, treat, or make health decisions. Always consult a qualified professional for medical or mental-health concerns. We do not guarantee any particular result, score change, or outcome.

Maxify rates physical appearance, and appearance-related feedback can affect mood, self-esteem, and body image. The scores are automated, subjective estimates — they are NOT a measure of your worth, your attractiveness, or your health, and they should not be treated as fact. Maxify is not a mental-health service. If using the app causes distress, anxiety, disordered eating, or any thoughts of self-harm, stop using it and seek help from a qualified professional or a crisis line in your area. By using Maxify, you acknowledge these risks and voluntarily assume them, and you agree that you use the app at your own discretion and risk.

Scores and suggestions are produced by an automated artificial-intelligence system. AI output can be inaccurate, inconsistent, incomplete, or unexpected, and the same photo may receive different scores at different times. We do not guarantee the accuracy, reliability, or suitability of any AI-generated result, and you should not rely on it for any important decision.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Maxify on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, distribute, sell, or create derivative works from the app except as allowed by law.

You agree to use Maxify only for yourself and only with photos you have the right to use. You will not upload photos of other people without their permission, use the app for any unlawful, harassing, or harmful purpose, attempt to disrupt or reverse-engineer the service, or misuse our AI provider's systems.

You represent and warrant that any photo you submit is of yourself, or that you have the explicit permission of the person shown, and that you have all rights necessary to submit it for analysis. You will not submit a photo of any other person without their consent, a photo of a minor (unless you are that minor's parent or legal guardian and you consent on their behalf), or any unlawful, obscene, or infringing content. You are solely responsible for the photos you submit and you agree to indemnify us for any claim arising from them.

Maxify offers an auto-renewing subscription ("Pro"). The current price is $7.99 per month following a 3-day free trial, unless otherwise stated at the time of purchase. Payment is charged to your Apple ID account at confirmation of purchase or at the end of the free trial. The subscription automatically renews at the same price each period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID account settings after purchase. If you cancel during a free trial, any unused portion of the trial is forfeited when you purchase a subscription. Prices may vary by region and are subject to change with notice as required by law.

Purchases are processed by Apple, and refunds are handled solely by Apple in accordance with the App Store's policies. We do not control and cannot issue App Store refunds.

Maxify, including its content, design, text, graphics, and software, is owned by Maxify or its licensors and is protected by intellectual-property laws. The photo you submit remains yours; you grant us only the limited right to transmit and process it to provide the analysis you requested.

Maxify is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that scores will be accurate or reliable.

To the fullest extent permitted by law, Maxify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) Maxify. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim or twenty U.S. dollars ($20).

You agree to indemnify and hold harmless Maxify from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the app, your violation of these Terms, or your violation of any law or the rights of a third party (including uploading another person's photo without consent).

These Terms are between you and Maxify only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the extent the app fails to conform to any applicable warranty and you notify Apple, Apple may refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal-or-regulatory, and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government restricted-parties list.

To the maximum extent permitted by law, you release and discharge Maxify and its owners, officers, employees, and affiliates from all claims, demands, liabilities, and damages of every kind, known or unknown, arising out of or connected with your use of Maxify, the scores or suggestions you receive, or your reliance on them.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. First, you agree to try to resolve any dispute informally by contacting us at the email below at least 30 days before starting any formal proceeding. If we cannot resolve it, you and Maxify agree that any dispute arising out of or relating to these Terms or the app will be resolved by final and binding individual arbitration, rather than in court — except that either party may bring an individual claim in small-claims court. YOU AND Maxify WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, class arbitration, or any representative proceeding; disputes must be brought only in an individual capacity. If the class-action waiver is found unenforceable as to a particular dispute, then this arbitration section does not apply to that dispute. To the extent applicable law (including for minors or certain consumers) does not permit binding arbitration or these waivers, this section applies only to the fullest extent permitted. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

To the extent permitted by law, any claim arising out of or relating to Maxify or these Terms must be filed within one (1) year after the claim arose; otherwise it is permanently barred.

We may suspend, restrict, or terminate your access to Maxify at any time, with or without notice, including for any violation of these Terms or any use that creates risk or legal exposure for us. You may stop using the app at any time by deleting it. Provisions that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, release, and dispute-resolution terms — will survive.

If you send us ideas, suggestions, or feedback about Maxify, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, with no obligation or compensation to you.

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of third-party providers (such as our AI provider or the app stores), network or device failures, acts of God, or government actions.

We may change, suspend, or discontinue any part of Maxify at any time. We may also update these Terms; when we do, we will revise the "Effective" date and, where appropriate, notify you in the app. Continuing to use Maxify after a change means you accept the updated Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, except where local consumer-protection law requires otherwise.

These Terms, together with the Privacy Policy, are the entire agreement between you and Maxify regarding the app and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor or affiliate. Section headings are for convenience only. You agree that we may provide notices and communicate with you electronically, including within the app or by email, and that electronic communications satisfy any legal requirement that such communications be in writing.
